General terms and conditions / Conditions of purchase

The present General Terms and Conditions (hereinafter referred to as the GTC) contain the terms and conditions of use of the online platform (Service) operated by Beadtex Kft.(Debrecen, Piac utca 66 4/18, name of the court of registration: Debrcen General Court, as the Court of Registration, Cg: 09-09-023973, hereinafter referred to as the Operator or the Ltd.) on the website. Furthermore, by the express declaration made during registration, an online contract between the User and Beadtex Kft. is concluded at a distance by using the Service.

In this legal relationship, Beadtex Ltd. is the Operator, while the User is the User of the Service. The contract is concluded between the parties by way of an implied contract, the language of which is Hungarian or English. The contract is not filed separately and therefore not accessible afterwards. The conclusion of the contract is subject to successful registration and acceptance of the General Terms and Conditions, the provisions of which the User accepts as binding upon him/herself.

Beadtex Ltd, as the operator of the online advertising space gyongyom.hu, reserves the right to unilaterally modify these GTC. If the GTC are modified, this fact will be notified on our website and the current GTC will always be available on the dedicated area of our website.

The services of the website operated by the Operator are available to all those who have successfully registered, whether natural persons or legal entities, whose legal capacity and capacity to act are not restricted. By registering, the User acknowledges that:

A person over the age of 18 with capacity to act, or a representative of an entity, or a minor over the age of 14 with the consent of a legal adult representative, or a person who is self-sufficient in his/her own earnings and in any case registers by providing real user data and contact details on behalf of himself/herself or the entity he/she represents.

Home delivery by courier:

Your parcel will be delivered to you by GLS, who will contact you on the mobile phone number you have provided.
You can pay for the value of your order in advance by bank transfer or by credit card via Paypal.

If during this period the person authorised to receive the parcel is not at the specified delivery address, the delivery courier will contact the customer on the mobile phone number provided when placing the order and will agree on the next possible delivery time and location. The User/Customer is responsible for the delivery costs of the parcels not picked up.

Pick-up in person (Hungary, 4025 Debrecen, Széchenyi street 4 - Bead Shop)

You assemble the desired products from the comfort of your home, we will assemble them in our shop in Hungary, Debrecen. Within one working day of placing your order, we will check if we have enough products in stock and will let you know as soon as we have assembled your order.
Estimated assembly time: 1 working day

Detailed information on delivery charges will be provided on the dedicated area of the website. Delivery charges are determined on the basis of the delivery address and the method of payment.
Precise information on how to register and place an order and how to pay the fees will be provided on the relevant section of our website.

You can pay for your order by bank transfer. Payment by bank transfer (by bank transfer) Within one working day of placing the order, we will check whether the products ordered are available from stock in the quantities ordered. After that, the amount of the order plus the delivery costs will be transferred in advance to Beadtex Kft.

Data protection

Beadtex Ltd. respects and securely stores the User's personal data. The data provided during registration will be treated confidentially, subject to the provisions of the Data Protection Act in force at the time, and will be used only in the context of its own promotional campaigns, and will not be disclosed to third parties.

The Operator shall only make it available to the authorities in accordance with the applicable data protection provisions. In accordance with the Hungarian data protection provisions, the Operator shall cooperate with local, national or international authorities on a case-by-case basis, upon whose request the Operator shall provide the necessary data and information stored about the User.

Subject of the contract

The subject matter of the contract is the use by the User of the online platform operated by Beadtex Kft., on which the User can purchase the products of Beadtex Kft (Distributor/Seller) (registered office: 4025 Debrecen, Piac utca 66 4/18, Cg: 09-09-023973, EU VAT: HU24191395), which operates the website gyongyom.hu with the intention of reaching potential customers in Europe.

The warranty obligations related to the ordered products are fulfilled by the seller, and Beadtex Ltd. provides assistance to all registered Users in the use and management of the warranty. The contract between the Vendor and the User shall be deemed to have been concluded when the order submitted by the User/Orderer by e-mail has been confirmed by the Vendor.

Price of the product

The price indicated next to the products on the website is the price of the product, excluding delivery costs. The sale price is valid at the moment or, in the case of products on sale, for the period advertised on the website and becomes final only if confirmed by the Operator after the order has been placed. The final price of the product is the price indicated in the order confirmation. The Distributor reserves the right to change the price until the order is confirmed.
The full purchase price of the Product shall in all cases be payable to Beadtex Ltd. against payment of which the Seller shall issue an invoice.
Prices are quoted in HUF or EUR. Prices include VAT.

Responsibility of the Operator as an intermediary service provider

The Operator shall not be liable in any way whatsoever in connection with any invitations, offers and contracts resulting therefrom or the failure to conclude a contract which appear on the website maintained by it and which do not originate from it.
The Operator shall provide the possibility for parties entering into a contractual legal relationship with the help of the website to reach each other in the settlement of disputes and to settle their disputes between themselves, if possible by using the website.

The User shall archive the content available on the online interface, if necessary.

The Operator shall not be liable for any damages resulting from force majeure or other events beyond its control, including but not limited to

use or malfunction of the gyongyom.hu website,
alteration of data by anyone,
delays in the transmission of information,
viruses,
software failure, internet network failure, other technical failure,
line or system failure.

Right of withdrawal

Right of withdrawal/cancellation You have 14 days to withdraw from this contract without giving any reason. Likewise, if the contract for the provision of services has started, you have the right to terminate the contract without giving any reason within 14 days. The withdrawal/cancellation period expires 14 days after the date of conclusion of the contract. If you wish to exercise your right of withdrawal/cancellation, you must send a clear statement of your intention to withdraw/cancel to monper.gyonybolt@gmail.com. You may also use the attached model withdrawal/cancellation form for this purpose. 

You will exercise your right of withdrawal/cancellation in due time if you send your notice of withdrawal/cancellation before the expiry of the deadline indicated above.

Legal effects of withdrawal/cancellation

If you withdraw from this contract, we will refund all the consideration you have paid, including the cost of carriage (excluding any additional costs incurred because you have chosen a mode of carriage other than the cheapest usual mode of carriage offered by us), without delay and at the latest within 14 days of receipt of your notice of withdrawal. The refund will be made using the same method of payment as the original transaction, unless you expressly agree to a different method of payment; you will not incur any additional costs as a result of using this method of refund. We may withhold the refund until we have received the goods or you have provided proof that you have returned them, whichever is the earlier."

"You must return or hand over the product to us without undue delay and at the latest within 14 days of the date of your cancellation. The deadline is deemed to have been met if you send the product before the 14-day deadline and you bear the direct costs of returning the product.

In which cases can you exercise your right to a warranty?
In the event of a defective performance by Beadtex Kft, you can claim a warranty of conformity from the company in accordance with the rules of the Civil Code.

What rights do you have under a claim for a guarantee?

You can choose to exercise the following claims: you can request repair or replacement, unless the fulfilment of the claim you have chosen is impossible or would involve disproportionate additional costs for the company compared to the fulfilment of another claim. If you did not or could not ask for the repair or replacement, you can ask for a proportionate reduction in the price or you can have the defect repaired or replaced at the expense of the undertaking or, as a last resort, you can withdraw from the contract. You can also transfer your right to a different warranty, but you will have to bear the cost of the transfer, unless it was justified or the business gave a reason for it. 

What is the time limit for you to claim your rights under the accessory warranty?
You must give notice of the defect as soon as it is discovered, but no later than two months after the defect is discovered. However, you should note that you cannot claim for a defect after the two-year limitation period from the date of performance of the contract. 

Who can you claim against?

You can claim against Beadtex Kft.

What are the other conditions for enforcing your rights?
Within six months from the date of performance, there are no conditions for asserting a claim other than the notification of the defect if you can prove that the product or service was provided by Beadtex Kft. However, after six months from the date of performance, you will have the burden of proving that the defect that you have discovered existed at the time of performance.


Product Warranty

In which cases can you exercise your right to a product warranty?
In the event of a defect in a movable item (product), you may, at your option, exercise your right under point 1 or make a product warranty claim.

What rights do you have under your product warranty claim?
As a product warranty claim, you can only ask for the defective product to be repaired or replaced.

In which cases is the product defective?
A product is defective if it does not meet the quality requirements in force when it was placed on the market or if it does not have the characteristics described by the manufacturer.

What is the deadline for making a product warranty claim?
You have two years from the date on which the product was put on the market by the manufacturer to make a product warranty claim. After this period, you lose this right.

Against whom and under what other conditions can you enforce your product warranty?
You can only enforce your product warranty against the manufacturer or distributor of the movable item. You must prove that the product is defective if you want to claim under a product warranty.

The manufacturer (distributor) is only exempted from its product warranty obligation if it can prove that:

- the product was not manufactured or put into circulation in the course of his business, or

- the defect was not detectable according to the state of science and technology at the time when the product was placed on the market, or

- the defect in the product is due to the application of a law or a compulsory standard laid down by a public authority.

The manufacturer (distributor) need only prove one ground for exemption. Please note that you cannot claim both a warranty for accessories and a product warranty for the same defect at the same time. However, if your product warranty claim is successful, you may pursue your accessories warranty claim against the manufacturer for the replaced product or repaired part.

Complaints

The User may initiate proceedings before the competent consumer protection authority in the event of a complaint or a matter concerning the Operator's service. You can address your complaints to the following bodies:
